Parking Assignments by Unit
Policies and Procedures

 

REVISED December 5, 1998

These Rules and Regulations are adopted by the Board of Directors pursuant to the By-laws of the Association on
October, 1998.

ALL OWNERS AND NON-OWNER OCCUPANTS,GUESTS,RENTER OR RENTAL AGENCIES
SHALL COMPLY WITH THESE RULES AND REGULATIONS.
1.Common driveway,entrances and passageways shall not be obstructed or used for any other purpose than
ingress and egress from the complex and the units.
2.No article of decoration or recreation shall be placed in any common areas without permission of the
Board of Directors.
3.Entrances and passageways shall not be used for play areas.
4.Balconies,porches and decks shall be used only for the purposes intended.They shall not be used for
hanging garments,rugs or towels.
5.Each unit shall have one garage spot and only one outside parking space.Only ONE operating and
regularly driven vehicle shall be parked outside.Any exceptions must have permission from the Board of
Directors.
6.Parking for overnight guests will be on a first come first served basis.
7.No auto maintenance may be done in the lot;except for an emergency.
8.Boats,trailer and RV's may be parked in your outside spot from May 1 to October 31 only.
9.Any unauthorized vehicle parked outside will be towed away at owner's expense 48 hours after notice is
posted on the vehicle.
10.No work of any kind shall be done to the exterior walls or porches by any unit owner except with the
written permission from the Board of Directors.
11.TV dishes or antenna may be installed on the balcony ONLY with written permission from the Board of
Directors.
12.Reasonable care and consideration shall be made to avoid any loud noise or disturbance after 10:00 p.m.
13.Trash will be disposed of in plastic bags.The lid to the dumpster is to be kept closed at all times.
14.Owners are permitted to have pets.Long-term tenants may have pets ONLY with written permission of
the owner and the Board of Directors of the Homeowners Association.
15.No pets may be staked or tied to the outside of any building.Pets can be left on balconies only if they do
not create a disturbance for other occupants.
16.Owners will be liable for any damage to common elements caused by any pet in their unit.
17.Owners of pets will clean up and dispose of all pet feces.Leash laws apply outside the complex.
18.The Association assumes no responsibility or liability for any loss or damage to articles left in any
common area..19.Any damage to general common areas caused by owners,tenants or guests shall be repaired at the
expense of the owner.
20."FOR SALE"signs shall be displayed on the inside of the balcony window only.These signs must be of
professional quality and be first approved by the Board of Directors.
21.Barbecue grills shall be gas or electric operated only.They may be used on the balconies.Charcoal grills
are prohibited.
22.Delinquent Dues Collection Policy — Any owner delinquent in any dues owned the Association would::
A.Pay a $20.00 late fee if 30 days delinquent.
B.Have Cable TV service disconnected if 60 days delinquent.
C.Have a lien filed against their unit if 90 days delinquent.
23.Vehicles obstructing Snow Removal from the lot will be towed away at owner's expense 24 hours after
notice has been placed on the vehicle.
24.It is the responsibility of each owner to shovel and clear snow off balconies and porches.
25.Fireworks are prohibited.
26.The storage of any flammable items in garages is prohibited.
27.Owners may lease or rent their unit,upon such terms and conditions as the-owner may deem advisable,
subject to the following:
A.Any such lease or rental agreement shall be in writing and shall provide that the lease is subject to
terms of the Aspen Glen Declarations,Articles of Incorporation,By-laws of the Association,and the
Rules and Regulations of the Association.
B.Any failure of lessee or renter to comply with the terms of the Declarations,Articles,By-laws,or
Rules and Regulations of the Association shall be in default under the lease or rental agreement,
enforceable by the Board of Directors.
C.The maximum number of lessees/renters per unit shall not exceed two (2)per bedroom on leases that
exceed 30 days duration.
D.Upon the request of the Board of Directors,a signed copy of any lease or rental agreement on leases
that exceed 30 days duration will be provided to the Board of Directors and the management
company.
28.Abandoned or inoperable vehicles (defined as any vehicle which has not been driven under its own
propulsion for a period of three (3)weeks or longer),except as hereinafter provided,shall not be stored or
parked on any portion of the property.
A written notice describing the "abandoned or inoperable vehicle,and requesting removal thereof may be
personally served upon the owner or posted on the unused vehicle is such vehicle has not been removed
within seventy-two (72)hours.Thereafter,the Association shall have the right to remove the same
without liability to it.
The expense of towing/storage shall be charged to the vehicle owner.If the vehicle owner is a member of
the Association,the costs thereof shall be added to their next assessment due.
However,this shall exclude vehicles parked by Owners while on vacation for a maximum of 30 days.
(Wildernest Property Management,468-6025,must be notified of make,model,and license of vehicle(s)
being left in the parking lot.).29.It is the owner's responsibility to include these Rules and Regulations with all long-term leases.Also,
these Rules and Regulations must be posted in short-term rental units.
30.All window treatments must be neat and attractive.
ENFORCEMENT OF RULES AND REGULATIONS
1.The Board of Directors has the authority to institute a schedule of reasonable charges against owners or
their agents for violations of these Rules and Regulations,the By-laws,the Declarations and the Articles
of Incorporation.All fees,charges and penalties imposed by the Board of Directors or its managing agent
and costs incurred by the Association in enforcing the Rules and Regulations shall be considered
assessments enforceable against units as set forth in the By-laws and Condominium Declarations.
2.The Board shall have the authority to take any remedial action it deems appropriate in the event of a
violation of these Rules and Regulations,the By-laws or the Declarations,including assessments of
charges and penalties,the filing of a lien,the filing of action for injunction or money judgment,or filing
of a suit for unlawful detainer.
3.The foregoing Rules and Regulations are subject to amendment by the Board of Directors.
PENALTY SCHEDULE
First Offense:A written warning
Second Offense:$50.00 assessment against the unit
Third Offense:$100.00 assessment against the unit
Fourth Offense:$150.00 assessment against the unit
Fifth and Each Following Offense:$200.00 assessment against the unit
With regard to these penalties,the Board or their designated representative shall notify the owners in writing of
the violation and the potential penalties.The owner shall have 30 days from the postmark date of the written
